PM Boc: The civil and criminal codes modernise the Romanian society

 

 

 

Bucharest, June 22 /Agerpres/ - Prime Minister Emil Boc said on Monday, after a meeting in which the Government assumed responsibility before Parliament for the passage of the Criminal Code and the Civil Code, that the two draft codes are contributing to the modernisation of the Romanian society and are upgrading the Romanian legislation in line with the European Union requirements.

'Firstly, this is an overhaul of the Romanian judiciary. Just look at the Civil Code - it dates back to 1865, then the Criminal Code is from 1869 and within the Criminal Code there are 250 special laws enshrining criminal norms that were amended and supplemented over time. This argument alone would suffice for a plea for a new Civil Code and a new Criminal Code in order to accommodate the developments in the Romanian society and juridical theory with what today means and with the most important legislative solutions in the criminal legislation and jurisprudence of Romania,' said Boc.

He added that by passing the two codes, Romania has met a commitment to the European Union that related to its accession to the Union.

'Romania has pledged to pass these codes and codify the Romanian legislation in some forms. I believe the time has come for Romania to meet its commitment, and what we are doing today will assure that Romania will be treated within the European Union as a full member, without any further conditionality and obligations.' said Boc.

He also said the two codes will contribute to uniform law enforcement.

'Secondly, it is about the implementation of the constitutional principle that nobody is above the law. These two codes and the other two to follow - the Criminal Procedure Code and the Civil Procedure Code - will make sure justice is done fast and with smaller costs on the citizens,' said Boc.

Justice Minister Catalin Predoiu said in his turn that the passage of the two codes is an absolutely necessary step forward toward the modernisation of the country's judiciary.

He said the two draft codes went through a laborious process of conception at the level of the Justice Ministry and Parliament, and the Government assuming responsibility for their passage is 'the crowning of the project.'

'These codes are a big step forward. In terms of their normative contents, they are much above the legislative standards currently in force, and I would like to say that, in some parts, they are even above the European standards. I hope Parliament will pass the two draft codes and provide the Romanian justice with two modern tools that will allow its transformation into a more transparent and quicker one in the service of the citizens,' said Predoiu.
